10 OVER SURF VIDEO PLEDGE ACTIVATION TERMS AND VIDEO USE NOTICE
WAVELENGTH PHOTO ACTIVATION TERMS AND PHOTO USE NOTICE
WAVELENGTH PHOTO COMPETITION TERMS AND PHOTO USE NOTICE
Version date: 15 July 2026
These terms apply to the 10 Over Surf video pledge activation.
The video pledge activation is separate from the Wavelength photo competition. There is no competition, prize draw or prize linked to this video pledge activation.
1. Who we are
The 10 Over Surf video pledge activation is operated by 10 Over Surf.
Brand: 10 Over Surf
Promoter / legal entity / data controller: 10 Over Surf
Registered address: 10 Over Surf, C Space, 5-7 The Crescent, Newquay, Cornwall TR7 1DT
Contact email: [email protected]
Video activation supplier: FotoPronto
Privacy policy: https://10oversurf.com/pages/privacy-policy
2. About the video pledge activation
The 10 Over Surf video pledge activation allows guests to record a short video pledging their support for independent surf shops.
The video may include your image, voice, words, likeness, and any other personal information you choose to include in the recording.
After the video is recorded, you may be able to access a digital version of the video using an on-screen QR code, link or digital video portal.
The activation starts on Friday 24 July 2026 and may continue after that date.
There is no competition element, prize draw, prize, winner selection or reward attached to this activation.
3. Taking part
Taking part in the video pledge activation is optional.
You may be asked to make separate choices about:
- recording the video;
- accessing or downloading your video;
- allowing 10 Over Surf to use your video as part of the independent surf shops campaign;
- receiving marketing from 10 Over Surf or Wavelength, if that option is offered.
These choices are separate. You do not have to agree to campaign use or marketing in order to access your video.
4. Age and group participation
The person completing the video pledge and any opt-in must be aged 18 or over.
If more than one person appears in the video, one lead participant aged 18 or over must complete the opt-in and confirm that everyone identifiable in the video has agreed to take part and understands how the video may be used.
If anyone identifiable in the video is under 18, campaign use should only be selected where a parent or legal guardian, or another adult with appropriate authority, has provided consent for that person to appear in the video and for the video to be used as described in these terms.
If the lead participant cannot confirm this, the video should not be submitted for campaign use.
10 Over Surf may reject, remove or decline to use any video if it believes the necessary permissions have not been obtained.
5. Recording and access to your video
By taking part, you agree to the video being recorded so that the activation can operate and so that you can access your video through the QR code, link or digital video portal.
Recording the video does not automatically give 10 Over Surf permission to use the video publicly as part of the campaign.
Public campaign use requires a separate opt-in.
6. Campaign use opt-in
If you opt in to campaign use, you agree that 10 Over Surf may use your video as part of the campaign supporting independent surf shops.
This may include use of the full video, edited extracts, still images, screenshots, captions, written quotes from the video, your voice, and your likeness.
Campaign use may include 10 Over Surf event, editorial, website, email, social media, promotional, PR, press, internal presentation and recap content.
Campaign use may also include Wavelength channels where the content is being used to support the same independent surf shops campaign.
If 10 Over Surf intends to use the video in paid media, paid advertising or third-party partner advertising, this should be stated clearly in the opt-in wording. If paid media is not stated in the opt-in wording, paid media use is not included.
You will not receive payment, royalties, approval rights or other compensation for campaign use unless separately agreed in writing.
10 Over Surf will not use your video to create a synthetic likeness, deepfake or AI-generated impersonation of you without separate consent.
7. Editing and presentation
If you opt in to campaign use, 10 Over Surf may edit the video for length, format, aspect ratio, captions, subtitles, branding, music, graphics, accessibility, platform requirements and campaign storytelling.
10 Over Surf will not intentionally edit the video in a way that materially misrepresents the meaning of your pledge or presents you as supporting something materially different from the independent surf shops campaign.
8. Withdrawing permission
You can withdraw permission for future campaign use of your video by contacting [email protected].
If you withdraw permission after your video has already been published, 10 Over Surf will take reasonable steps to remove it from channels it controls.
10 Over Surf may not be able to remove copies that have already been shared, reposted, downloaded, screenshotted, cached or otherwise used by third parties.
9. Marketing
Recording a video and opting in to campaign use do not automatically sign you up to marketing.
If you choose to receive marketing from 10 Over Surf or Wavelength, this will be requested separately using a separate opt-in.
You can unsubscribe from marketing at any time using the unsubscribe link in marketing emails or by contacting [email protected].
10. Personal data
The personal data processed for the video pledge activation may include your video, image, voice, words, email address or contact details if collected, consent choices, QR code or portal access information, and technical information needed to operate the video activation.
10 Over Surf is the data controller for the video activation data and campaign use of opted-in videos.
FotoPronto acts as [DATA PROCESSOR / SEPARATE DATA CONTROLLER – CONFIRM WITH FOTOPRONTO] for the video activation platform.
Your personal data may be used to:

- record your consent choices;
- manage any campaign-use permissions;

- manage opt-outs, withdrawal of consent and data rights requests;
- send marketing only where separate marketing consent has been given.
11. Data retention
Video activation data will be kept for six months from the date the video is recorded.
Where campaign use has been selected, campaign copies and related consent records will be kept for six months from the date the video is recorded, unless consent is withdrawn earlier or a longer period is required to manage legal, audit or rights records.
Marketing consent records may be kept for as long as needed to show when and how consent was given, unless the law requires or permits a different period.
12. Your rights
You may have rights to access, correct, delete, restrict or object to the use of your personal data.
You may also have the right to withdraw consent where processing is based on consent.
To exercise your rights, contact [email protected].
You can also complain to the Information Commissioner’s Office if you are unhappy with how your personal data is handled.
13. Accessing your video
The video activation portal or QR code may allow you to access your video after it has been recorded.
Do not share your QR code or video access link with anyone you do not want to access the video.
10 Over Surf is not responsible for further sharing by participants once they have downloaded, posted or shared their own video.
14. Moderation
10 Over Surf may reject, remove or refuse to publish any video that it reasonably considers to be:
- offensive, abusive, discriminatory or unlawful;
- sexually explicit or inappropriate;
- unsafe or encouraging unsafe behaviour;
- infringing someone else’s rights;
- submitted without the necessary consent of everyone shown or heard in the video;
- inconsistent with the spirit of the event, 10 Over Surf, Wavelength or the independent surf shops campaign.
15. Changes to these terms
10 Over Surf may update these video pledge activation terms where needed.
The version shown at the time you take part will apply to your participation.

These terms are governed by the laws of England and Wales, unless mandatory consumer law provides otherwise.

3. Taking part
